Grave error: City workers mistakenly remove flowers from LaFayette Cemetery

The city of LaFayette is fielding a flood of angry calls after city workers mistakenly removed flowers from graves at LaFayette Cemetery.

Charlcey Frye, whose father is buried there, said she recently bought flowers for the grave. “Now they have been thrown away,” Frye said.

The city published a legal notice in the Nov. 13 edition of the Walker County Messenger telling the public it planned to clean up the cemetery, including removal of all floral decorations. The cleanup, the notice said, would begin Nov. 16. (Read the full text of the notice below.)

The notice also explained that “permits are required before placing anything other than flowers in the cemetery.” The notice did not specify whether that included artificial flowers.

On Tuesday the city issued a written statement explaining that “some fresh flowers” were mistakenly removed. (Read the full text of the statement below.)

Mayor Neal Florence said the city will have a meeting on the cemetery dilemma Thursday night. The meeting, which is open to the public, will be held at 6 p.m. at City Hall.

“The cleanup that happened was not what the city intended,” Florence said. He said the idea was to pull out the dead flowers, not the new ones.

Florence pointed out that it is the city’s responsibility to preserve and maintain the cemetery.

Frye pointed out that the public notice said flowers and other items would be placed in storage. But she learned the flowers were thrown away.

“They didn’t store them. They threw them away. That is my lot, my dad’s, and that is very sentimental,” Frye said.

Frye said that, due to the weather, flowers are going to fade and the city should not just remove them and throw them away.

“Yeah, they are going to be faded. They have been in the weather and that doesn’t give the city or anyone the right to take flowers off my dad’s grave,” Frye said. “They might be faded, but I redo them.”

Frye said she does not have a receipt to give the city so she can be reimbursed for the flowers.

“I paid for the flowers in cash. I did not keep a receipt because I never would have thought that the city would go over there and throw them all away,” Frye said.

Dalton resident Marsha Godfrey, whose father is buried in the cemetery, said she travels to LaFayette regularly to take care of and place flowers on her father’s grave.

“I was highly upset. It (the deed to the lot) didn’t say you needed to change your flowers at a certain time,” Godfrey said. “We change my dad’s flowers every three to four months.”

Godfrey said she understands the city’s policy on not placing items such as benches, without a permit, at the gravesites. But she does not understand why the flowers were removed.

“I just wish that they could understand our feelings on this,” Godfrey said. “I go to my father’s grave every two weeks.

“Those flowers cost and with the economy the way it is, we can’t afford to buy new flowers every two weeks. They don’t care. They must have never lost a loved one.”

Godfrey said she and her family tends to her father’s lot by distributing weed killer around the lot, so that the city only has to mow around the sides.

“I hope they stop and take a look at what they are doing to people’s feelings,” Godfrey said.

This is the legal notice published by the city in the Nov. 13 edition of the Walker County Messenger

“Beginning November 16th, 2009 all floral decorations will be removed from all grave sights. If you wish to keep your arrangements please do so before this date. The lawn care contractors will begin November 16th cutting, pruning and removal if necessary of overgrown trees, shrubbery, etc. as needed. As the result of numerous calls referencing unsightly and unkept grave lots that have had items such as benches, lanterns, figurines, copings and other items placed on or around them that prevent the proper maintenance being performed will be looked at, and any that have not requested permission by a permit as required, will be removed and kept in storage for collection at your convenience for a period of 60 days. All of the items listed are covered on the back of your Certificate for Internment and/or Burial Rights.

The city of LaFayette issued this written statement on Tuesday

“To clarify some of the confusion about the LaFayette City Cemetery, please read the following:

The City of LaFayette is in the process of cleaning and improving the condition of the cemetery. Removal of certain items during this process has caused questions concerning the rules regulating decoration of individual plots. The current rules have been in existence for several years, and they have not changed.

“Recently, a notice was published in the Messenger, and also aired on WQCH Radio, stating that the City would be enforcing the existing cemetery rules. The notice also pointed out that the rules are printed on the back of the deeds to the cemetery lots.

“The rules provide in part that permits are required before placing anything other than flowers in the cemetery. There is no charge for the permit, but the permit must be obtained. Permits may be obtained at the Public Works Department located on the LaFayette bypass.

“During the work to improve the condition of the cemetery, some fresh flowers were removed in error. The intent of the City was to remove only the old and faded arrangements, but the fresh flowers were also removed in the process.

“Upon knowledge of the mistake, the City immediately began taking action to correct the situation. Any family member who had a floral arrangement removed in error is urged to come by City Hall and complete a claim form.

“The City is sensitive to the condition and maintenance of the cemetery and works hard to keep the cemetery in a good condition. The City sincerely regrets any inconvenience or concern this matter has caused and is diligently working to rectify the situation.

“For a copy of the rules regarding the LaFayette City Cemetery, contact the City Manager’s Office at City Hall.”

I have given alot of thought about the situation with the cemetery,What I am angry about most is that the City Of LaFayette thought they had the right to come and steal from the citizens of LaFayette I am not a attonery but that doesn't seem leagal. I personally take care of my parents grave and I don't ask for help from the City because you do not get it. I have lived in the City for 50 years and have never seen anything like this before. I went back and read minutes of council meetings and the only thing I could find in refrence to the Cemetery was on October 12 meeting and here is what was discussed."CONCILMAN SWANSON MADE A MOTION TO PUT UP SIGNS IN THE CITY CEMETERY STATING THAT YOU MUST CLEAN UP AFTER YOUR ANIMALS. COUNCILMAN CRAIG SECONDED THE MOTION. MOTION CARRIED 5-0. HE ALSO ASK RICHARD MOORE TO MONITOR OBJECTS AND OTHER ITEMS BEING PLACED ON OR NEAR GRAVES."

By placing these signs in the Cemetery it is clear to me that they pick and choose which rules to follow since on the back of the deed it clearly states no pets are allowed in the cemetery.

As for the flowers that were removed and discarded like common trash they will refund your money with a receipt out of city budget money tax payers money, so once again the citizens of LaFayette are having to pay for mistakes that we did not make. What I would like to see is the person who wrote the notice and gave it to city workers have to take responsibility for his own actions I think all of the familys deserve an apology from him as well he should loose his job or at the very least suspend him without pay that might cover some of the money that will have to be paid out for flowers. Our loved ones that we trusted and placed as their final resting place where we could go and be with them has been violated in the worst way and now that trust with the City is gone. I know I will remeber this and the pain and emotional stress this has cause me, when elections come around again as I think alot of people will. LaFayette needs some changes if people stay in office too long it is not good for the city we need new blood and new ideas someone that will not think too much about the golf course. That will actually take in consideration what the citizens of LaFayette want and need. Maybe all of us should start paying closer attention to the council meetings I know I will.

PLEASE DO NOT FORGET THE MEETING ON DEC. 14 @ 7:30 EVERYONE NEEDS TO BE THERE NEW RULES AND REGULATIONS ARE GOING TO BE REVEALED.

The city doesn't care about anyone.They took the lowest bidder to do the lawn work and they didn't want to work around all the benches and things people leave on their families graves because it was probably more work that they planned on.Their was a toy train on a little boys grave in the cemetery the last time I was over there.I wonder if it is still there?I bet it isn't.

I think this is the MOST horrible thing any human being could possibly do.I have a friend whos infant daughter is buried in that cemetary things that was on that grave was things of sentiment to the family...HOW DARE THE CITY JUST TAKE WHAT DIDNT BELONG TO THEM OFF THAT GRAVE!!!WHAT GIVES THEM THE RIGHT TO DO THAT TO THE FAMILY AND THE MOTHER???I PERSONALLY THINK THAT EACH PERSON THAT HAS A FAMILY MEMBER OR LOVED ONE IN THAT CEMETARY NEEDS TO SUE THE CITY OF LAFAYETTE GA FOR PAIN AND SUFFERING I FOR ONE WILL BACK EVERYONE UP

according to reports , i understood that it was just too much work for them and that is why this happened. regardless of whether it is the city or a lawn service, they are being paid to do a job, they knew the job when they took it, and now they have gotten too lazy to do it and took a lot of costly items , as well as causing a lot heartache to these families , because they are lazy as hell !!!!!!! i think they are sorry and will have to pay in the next life as well as they ones who gave them the go ahead to do it ! these people are no better than the grave robbers or people who vandelize graves !!

The city does not mow the cemetery,it is mowed by lawn service.

I may be wrong,but i thing the service was the one that said they could mow for the items.

But if they took the job,they need to be able to handle the extra work.

a good friend of mine rachel (bradley) bolten is buried there and her family has spent a lot of money on her grave !!! i stopped by 2 or 3 weeks ago to visit the gravesite and i would say they have put close to $300 in benches, flowers, gazing balls, etc. all around her grave. i am sure there are many more like hers as well. what is the city planning to do for these families?? i personally think that your city workers are lazy as hell if they can't clean around these things, after all, isn't that what they are being paid in part to do ??? and honestly, how much of these things did they take home with them !!!!!!!!

I think it is really bad the way the city did by taking these people's flowers and things off of their loved one's grave. I don't have anyone buried there and it is a good thing because I wouldn't take this lightly. I just lost a loved one and had to bury them and I am glad I didn't bury them there. People ought to have the respect not to bother someone who has been laid to rest. You would think when you better a loved one that they could rest in peace, but I guess not and you know people don't have that kind of money for the city to send people in their to clean the graves and take the flowers. You need to think of how you would feel if you had loved ones and this happened to you. I just think this is pretty messed up.

Monday and seen the prisoners and the city workers cleaning but little did i know they was taking every thing off.If I had known I would have call the police and roported them. I Think this is very much disrespectful not to the familys but to the one that have passed away. The mayor way or of saying he is sorry is it was a misunderstanding and a mishave. But come on if we had went and done something like that where would we been you guess it in the lovely hotel of Walker county jail.There is a meeting Thursday night about the so called mishave so plz go and speek out and help make this right and don't let this go unheard about.I ask that you not blame the prisoners they are only doing as they are ordered and that it was also the state prisoners and as was some of the city workers but place the blame on the one that ordered them to do the work. Put in mind that in the Walker county jail that the inmates are not being treated the way they should meals have been cut and then watered down and frozen at times when you would think that at least you have a blanket thats when they have none.so lets all make a stand.

The notice said All in the statement in the paper and that is what was done. It's cruel to pass the buck down to the city worker.

This is retarded. When someone complains about a grave having "unsightly" memorabilia on their family member's grave site, you know that this world/city is a total pile of crap. What kind of snob would care what is on someone's grave? Judging the living is one thing, but when someone starts judging a dead person's resting place, that's atrocious. If the City of La Fayette was half as worried about the economy of La Fayette instead of a bunch of flowers and sidewalks, it probably wouldn't have a 20% unemployment rate.

God, these city leaders are idiots. Stop giving subsidies to Wal-Mart! How much did the City of La Fayette pay Wal-Mart to move to La Fayette? I bet the amount is in the hundreds of thousands. All of you blind sheeple herd yourselves inside that dirty business as blindly as cow to be slaughtered.
